AI Image Change Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the AI Image Change website. By accessing or using our services, you agree to be bound by these Terms.

If you use the services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

These Terms do not limit any mandatory consumer rights under applicable law. If any term conflicts with mandatory legal requirements, the law prevails.

2. Eligibility and Accounts

You must provide accurate and complete account information and keep it up to date.

You are responsible for maintaining account security and for activities under your account. If you suspect unauthorized use, you must notify us promptly.

3. Service Scope and Changes

We provide AI-powered tools for generating and editing content. Features may vary by plan, region, model/provider availability, and technical constraints.

We may add, remove, or modify features to maintain security, legal compliance, or service quality. Planned maintenance and third-party outages may affect availability.

4. Plans, Billing, and Auto-Renewal

• Paid services may include subscriptions and/or one-time credit packages.
• By purchasing, you authorize us (or our payment provider) to charge your selected payment method.
• Subscription plans auto-renew by default unless canceled before the next billing cycle.
• Cancellation stops future renewals and does not automatically refund the current cycle.
• Prices, taxes, and applicable fees may change. Where required by law, we will provide notice before material pricing changes take effect.
• If payment fails or is reversed, we may suspend paid features until billing issues are resolved.

5. Refunds and Chargebacks

• Refund requests are handled under our Refund Policy.
• Except where required by applicable law or otherwise agreed in writing, consumed credits or used subscription entitlements are generally non-refundable.
• Duplicate charges, verifiable billing errors, and platform-side service incidents may still be reviewed case-by-case under the Refund Policy.
• For orders already under chargeback review, duplicate refund processing may be paused until the chargeback outcome is finalized.

6. Acceptable Use

You agree not to:

• Use our services in any way that violates any applicable law or regulation
• Infringe intellectual property, privacy, publicity, or other rights
• Upload or generate malware, harmful code, or abusive content
• Upload, request, generate, or distribute sexually explicit, pornographic, adult sexual, or NSFW content, including AI-generated sexual content
• Use the service for face-swap, deepfake, impersonation, or face-manipulation content that violates rights, consent, safety rules, or applicable law
• Attempt to bypass content moderation, safety controls, rate limits, billing controls, or abuse-prevention systems
• Attempt unauthorized access, model abuse, scraping, quota circumvention, or service disruption
• Resell, sublicense, or mirror the service without authorization

We may reject prompts, block generations, restrict accounts, remove content, or suspend or terminate access when we reasonably believe content or behavior violates these Terms, our safety policies, payment-provider requirements, or applicable law.

7. User Content and AI Output

• You retain rights in content you submit ("Input"), and subject to applicable law and third-party rights, rights in generated output ("Output").
• You represent and warrant that you have the necessary rights to submit Input and use Output.
• You are responsible for reviewing Output before use, including legal, compliance, factual, and safety review.
• AI Output may be inaccurate, incomplete, non-unique, or similar to content generated for others.
• You grant us a worldwide, non-exclusive, royalty-free license to process Input and Output solely to operate, secure, investigate abuse, and improve the service as described in our Privacy Policy.

8. Intellectual Property

The website, product design, code, trademarks, and service materials (excluding your Input/Output) are owned by us or our licensors and protected by applicable laws.

We grant you a limited, revocable, non-transferable, non-exclusive license to use the service in accordance with these Terms.

9. Third-Party Services

Our services may rely on third-party providers (including payment processors and model providers). Third-party downtime, policy changes, or restrictions may affect availability or results.

Use of third-party services may also be subject to their own terms and policies.

10. Suspension and Termination

We may suspend or terminate access immediately if we reasonably believe you violated these Terms, posed security/fraud risk, or caused legal exposure.

Upon termination:

• Your right to use the service ends immediately
• Related credits/benefits may be revoked in accordance with our policies
• Outstanding payment obligations remain due

Sections intended to survive (including payment obligations, IP, disclaimers, liability limits, dispute terms, and indemnity) remain in effect after termination.

11. Disclaimers

To the fullest extent permitted by law, services are provided "as is" and "as available" without warranties of any kind, express or implied, including, without limitation, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities.

Our aggregate liability for all claims related to the services will not exceed the total amount you paid to us for the relevant service during the 12 months before the event giving rise to liability.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, and service providers from claims, liabilities, damages, losses, and costs (including reasonable legal fees) arising from:

• Your use or misuse of the services
• Your Input, Output, or content-related disputes
• Your violation of these Terms or applicable law

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where the contracting operating entity is established, without regard to conflict-of-law principles.

Unless otherwise required by mandatory law, disputes shall be submitted to the courts with competent jurisdiction in that location.

If you are a consumer, mandatory local consumer protection laws may grant you additional rights or forum choices.

15. Changes to Terms

We may update these Terms from time to time. The updated version becomes effective when posted with a revised date, unless a later effective date is stated.
